Now my insurance company denied my claim cause they say he wasnt under the insurance. but should my car be cover regradless if the person driving wasnt? I mean I pay monthly payments and then they are just gonna deny me after an accident. could anyone help me? any advice?

If you policy is a stated driver policy, he will NOT be covered unless you have named him as an additional driver. If he is licensed, he should have his own insurance that covers him and any damage he does to others vehicles.

Not all policies cover all drivers. Many will not cover anyone not named under age 25, and some will not cover anyone not named that lives at the same address as yours.
Best bet is to read the policy, but if they have told you they don’t cover anyone not named, you can bet that is what you will find when you read it.
Yes, if he isn’t covered, they can and will deny you.

It’ s not that simple like everything else in life there is some fine print that applies here to exclude him.
For instance, if your bf lives with you and not listed on your policy and the car is made available for his regular use then no they probably don’t have to cover it.
I have assume they sent you a denial letter with an detailed explanation of why they denied coverage. If you care to give us more details, it would be easier to answer your questions and possibly help you.

Without having access to your policy, nobody can really answer your question. However, if he was thought to be a regular user and he is not listed, then yes, they can deny your claim.
If he was at fault for the accident and caused damage to another person, he should notify his insurance company. Your insurance company MAY also deny liability coverage.
If you disagree with their decision, you can file a complaint with your State’s Insurance Commissioner.

I can’t speak for every company but with the companies that I represent anyone who is not a household member can drive your car, but licensed drivers living in the household must be listed on the policy.
Following is a site that lists all the state insurance departments where you can request help.
Go to and click on the link at the bottom of the page called “Helpful Links” and then click on the link to the Department of Insurance in your state.
